Shields and Swords Security
Together with a loan agreement drafted by solicitors, I use three types of security to give my investors comfort when investing cash with me for a return.
The three types of security I offer are;

• A Shield (legally this a Restriction registered at The Land Registry against a property with sufficient equity to cover the investment. This prevents the restricted property from being sold or remortgaged without the investor’s permission).
• A Small Sword (legally this is a second charge registered at The Land Registry against a property with sufficient equity to cover the investment. This prevents the charged property from being sold or remortgaged without the investor’s permission and also allows the investor to force a sale or equity recovery, subject to any first charge holder).
• A Large Sword (legally this is a first charge registered at The Land Registry against a property with sufficient equity to cover the investment. This prevents the charged property from being sold or remortgaged without the investors permission and also allows the investor to force a sale or equity recovery).
The level of security I use is always proportional to the level of relationship between the lender and borrower.
The large sword is appropriate where there is no personal relationship and hence no trust, and is commonly used for lending from institutions offering mortgages.
The small sword is appropriate where there is already a first charge in place and the level of relationship and hence trust between the lender and borrower is low.
The shield is appropriate where there is a level of trust between the lender and borrower and therefore a sword is not needed.
